Terms and Conditions

1. Acceptance of Terms

By accessing or using the Site, submitting a contact or estimate request, or entering into a service agreement with Elk Grove Asphalt Paving, you confirm that you are at least 18 years old and that you accept these Terms. We reserve the right to update these Terms at any time by posting a revised version on the Site. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. Description of Services

Elk Grove Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot striping, and related services to residential and commercial customers in Elk Grove, CA and surrounding communities. The Site is used to provide information about those services and to facilitate estimate and contact requests.

Submitting a form on the Site does not constitute a binding service agreement. A service agreement is only formed when both parties have signed a written proposal or contract.

3. Estimates and Pricing

All estimates provided by Elk Grove Asphalt Paving are based on information available at the time of the estimate and are subject to change. Final pricing is determined after an on-site inspection and confirmed in a written proposal.

Estimates are valid for 30 days from the date of issue unless otherwise stated in the written proposal. Pricing may change after 30 days due to material costs, labor rates, or changes in site conditions.

Any work beyond the scope described in the written proposal will be subject to a separate written change order and additional charges before the extra work begins.

4. Scheduling and Cancellation

Work dates are scheduled based on crew availability, weather conditions, and material supply. We reserve the right to reschedule work due to weather, equipment issues, or other circumstances outside our control. We will notify you as soon as possible if a rescheduling is necessary.

If you need to cancel or reschedule a scheduled job, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice may be subject to a cancellation or mobilization fee as described in your written proposal.

Asphalt and sealcoating work requires appropriate weather conditions. Jobs may be delayed or rescheduled if conditions are unsuitable, at our discretion.

5. Payment Terms

Payment terms are specified in the written proposal for each job. Unless otherwise stated in writing, payment is due upon completion of the work. For larger projects, we may require a deposit before work begins, as described in the written proposal.

Accepted payment methods will be specified in the written proposal. We do not accept full upfront cash payment from customers who have not previously worked with us.

Invoices not paid within the terms specified in the written proposal may be subject to a late fee. Accounts more than 30 days past due may be referred to a collections agency, and the customer will be responsible for any associated collection costs.

6. Customer Responsibilities

You are responsible for:

• Providing accurate information about your property and project when requesting services
• Ensuring the work area is clear of vehicles, personal property, and obstructions before the scheduled start time
• Notifying us of any underground utilities, irrigation lines, or other buried infrastructure in the work area
• Obtaining any required permits from your homeowners association (HOA) or local authority before work begins, unless we have agreed in writing to handle permitting on your behalf
• Keeping children and pets off newly paved or sealed surfaces for the curing period specified by our crew

Elk Grove Asphalt Paving is not responsible for delays or damage resulting from a customer's failure to meet these responsibilities.

7. Warranty Disclaimer

Any warranty provided by Elk Grove Asphalt Paving will be stated expressly in the written proposal for the job. Warranty coverage is limited to defects in workmanship and materials under normal conditions.

Warranties do not cover damage caused by factors outside our control, including but not limited to: expansive or unstable soils, tree root intrusion, vehicle fluid spills, extreme weather events, unauthorized repairs or modifications by third parties, or normal wear and weathering.

THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Elk Grove Asphalt Paving and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from services provided under any agreement, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from our services will not exceed the amount you paid us for the specific services giving rise to the claim.

9. Intellectual Property

All content on the Site - including text, images, logos, and graphics - is the property of Elk Grove Asphalt Paving or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written consent.

10. Dispute Resolution

If a dispute arises from your use of the Site or from services we provided, we encourage you to contact us first so we can work toward a resolution directly.

If a dispute cannot be resolved informally, both parties agree to attempt non-binding mediation before pursuing litigation. Any unresolved disputes will be subject to the jurisdiction of the courts of California, and both parties consent to venue in Sacramento County, California.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these Terms or from services provided by Elk Grove Asphalt Paving will be brought exclusively in the courts of California.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes take effect when posted on the Site. The effective date at the top of this page will be updated whenever changes are made. Your continued use of the Site or engagement of our services after any change constitutes your agreement to the revised Terms.
